Retrograde extrapolation in a Tennessee DUI case is a scientific method used to estimate a person’s earlier blood alcohol concentration from a blood or breath test administered later. The test records alcohol concentration at the time of testing, not directly at the earlier time of driving. This difference can become important when reviewing BAC testing in Tennessee DUI cases, especially when hours passed before a blood sample was collected.

Retrograde extrapolation does not recreate an earlier BAC with certainty. The calculation depends on the measured result, the elapsed time, the alcohol-elimination rate used, the person’s absorption status, and the factual information available to the toxicologist. A rising BAC argument or a challenge to the calculation must be supported by the evidence. Neither argument guarantees that a DUI charge will be dismissed.

What Does Retrograde Extrapolation Mean?

Retrograde extrapolation works backward from a known alcohol-test result. A toxicologist starts with the BAC measured when the sample was collected and estimates a possible BAC at an earlier time.

For example, assume that a blood sample collected two hours after driving produced a BAC result of 0.08%. A toxicologist could estimate the amount of alcohol eliminated during those two hours and add that amount to the later result. The calculation may produce an estimated range rather than one number.

The Tennessee Court of Criminal Appeals has defined extrapolation as the use of scientific evidence to relate the alcohol level at the time of testing back to the time the vehicle was operated. The court has also recognized that the method involves uncertainty and that individual differences in alcohol absorption present an important reliability concern. State v. Greenwood, 115 S.W.3d 527, 531–33 (Tenn. Crim. App. 2003); State v. Tamela Scott, No. M2006-02067-CCA-R3-CD, 2008 WL 4253722, at *17–18 (Tenn. Crim. App. Sept. 17, 2008).

How Is an Earlier BAC Estimated?

The calculation starts with the reported BAC, the test time, and the alleged driving time. The toxicologist then applies an alcohol-elimination rate to the period between driving and testing.

A person’s actual elimination rate is rarely measured during a DUI investigation. A toxicologist may instead use a range of rates drawn from accepted scientific research. Different rates can produce different estimates.

Assume that two hours passed before a blood draw. Applying a lower elimination rate will produce one estimated BAC at the driving time. Applying a higher rate will produce a higher estimate. The result may be a range that falls below 0.08%, exceeds 0.08%, or crosses the 0.08% threshold.

A range that crosses the statutory limit does not identify one definitive BAC. It shows that the conclusion changes depending on the elimination rate applied.

Why Alcohol Absorption Matters

Retrograde extrapolation is closely connected to the difference between alcohol absorption and alcohol elimination.

After alcohol is consumed, it passes from the digestive system into the bloodstream. BAC rises during this absorption phase. It reaches a peak and later declines as the body eliminates alcohol.

The timing of that process can be affected by food consumption, drinking pattern, the amount and type of alcohol consumed, body characteristics, and other individual factors. Tennessee appellate decisions have identified variations in absorption as a central concern when evaluating retrograde-extrapolation testimony.

A calculation that adds eliminated alcohol back to a later test assumes that the relevant person was in the elimination phase during the period being calculated. If the person was still absorbing alcohol, the later BAC could be higher than the BAC at the earlier driving time.

The important question is not limited to how much time passed. The analysis must also consider where the person may have been on the alcohol curve – absorbing alcohol, approaching peak concentration, or eliminating alcohol.

What Is a Rising BAC Argument?

A rising BAC argument asserts that the person’s alcohol concentration was lower while driving and increased before the blood or breath test.

Consider a person who consumed alcohol shortly before leaving a restaurant. If the alcohol had not been fully absorbed when the person began driving, a later test might record a higher concentration than existed during the drive.

The passage of time alone does not prove rising BAC. The argument may depend on the last-drink time, the amount consumed, the pace of drinking, food intake, departure time, driving time, and test time.

Receipts, surveillance footage, witness testimony, body-camera recordings, text messages, phone records, restaurant records, and statements made during the investigation may support or contradict the proposed timeline.

Rising BAC is not a separate statutory defense contained in Tennessee’s DUI law. It is an evidentiary argument concerning what a later test does—or does not—establish about the person’s BAC while driving.

Is Rising BAC the Same as Retrograde Extrapolation?

The concepts are related, but they are not the same.

Retrograde extrapolation is a calculation intended to estimate an earlier BAC from a later result. An elimination-based calculation assumes that BAC was declining during the relevant period.

A rising BAC argument challenges that assumption. It raises the possibility that the person remained in the absorption phase and that the later result overstated the BAC at the driving time.

A valid analysis must therefore address the absorption question before treating a later result as a reliable basis for adding alcohol back over time.

What Information Can Affect the Calculation?

The reliability of retrograde extrapolation depends on the starting data and the assumptions used.

The original test result must first be evaluated. Sample identification, collection procedures, chain of custody, storage conditions, laboratory methods, quality-control records, instrument performance, measurement uncertainty, and reporting can affect the result used in the calculation.

The relevant times must also be supported. An inaccurate driving time, crash time, arrest time, warrant time, or collection time can change the estimated range.

The person’s absorption status matters because adding alcohol back assumes elimination. Information about the last drink, food intake, drinking pattern, and possible alcohol consumption after driving can affect that assessment.

The selected elimination rate can also change the outcome. Using one average rate may suggest a level of precision that does not exist when the person’s actual rate is unknown. Applying a scientifically supported range presents the uncertainty more directly.

How Does Tennessee Law Address This Testimony?

Tennessee’s DUI statute does not prescribe a mathematical formula for retrograde extrapolation. Tenn. Code Ann. § 55-10-401 prohibits driving or being in physical control of a motor vehicle under separate theories, including impairment under subsection (1) and an alcohol concentration of 0.08% or more under subsection (2).

When a party offers retrograde-extrapolation testimony, admissibility is evaluated under Tennessee’s rules governing scientific and expert evidence. Rule 702 permits qualified opinion testimony when specialized knowledge will substantially assist the finder of fact. Rule 703 requires the opinion to rest on trustworthy facts or data and directs the court to disallow an opinion when the underlying information indicates a lack of trustworthiness.

The trial court acts as a gatekeeper. The court examines the witness’s qualifications, the connection between the data and the conclusion, the reliability of the method, and the factual foundation for applying that method to the case.

Tennessee decisions do not establish that every retrograde-extrapolation opinion is admissible. They also do not establish that every disagreement between toxicologists requires exclusion. When competing opinions rest on scientifically supportable grounds, the dispute may be addressed through cross-examination, competing testimony, and the weight assigned to each opinion.

What Did the Court Decide in State v. Tamela Scott?

In State v. Tamela Scott, blood testing occurred hours after a fatal collision. The prosecution’s toxicologist used retrograde extrapolation and estimated a BAC of 0.102% at the collision time. He acknowledged that he used an assumed average elimination rate and that changing the rate produced a much wider possible range of 0.073% to 0.168%.

The Court of Criminal Appeals upheld the admission of the testimony. The toxicologist had explained that his calculation was an estimate, identified the assumptions involved, acknowledged individual variation, and did not present the estimate as absolute.

The court emphasized that scientific opinion must rest on sufficient facts and must not amount to speculation or mislead the jury. The limitations placed before the jury were important to the court’s analysis. The decision does not establish that an average elimination rate will be acceptable in every prosecution. It reflects the testimony, objections, foundation, and limitations presented in that record.

What Did the Court Decide in State v. Whaley?

The Tennessee Court of Criminal Appeals addressed a detailed retrograde-extrapolation dispute in State v. Justin David Whaley, No. E2024-00387-CCA-R3-CD, 2025 WL 3541414 (Tenn. Crim. App. Dec. 10, 2025).

The case arose from a fatal Hamilton County collision. A blood sample collected approximately four hours after the crash produced a reported BAC of 0.020%. The prosecution toxicologist estimated that the defendant’s BAC at the crash time ranged from 0.056% to 0.120%. The defense presented its own toxicologist and challenged the formula’s application to the measured result.

The trial court expressed reservations and described the extrapolation as reaching the limit of reliability under the circumstances. It did not permit the prosecution to present one precise BAC based on an average elimination rate. The court allowed testimony about a range calculated with recognized minimum and maximum elimination rates and required the witness to acknowledge that the defendant’s actual rate was unknown.

The Court of Criminal Appeals upheld the limited testimony. Both toxicologists accepted retrograde extrapolation in principle, relied on recognized sources, and agreed on several foundational points. Their dispute concerned the application of the method to the facts. The appellate court concluded that the trial court did not abuse its discretion by allowing the restricted opinion and leaving the competing scientific positions for the jury to evaluate.

The decision does not authorize every four-hour extrapolation. Its holding depends on the detailed evidentiary record, the competing testimony, and the restrictions imposed by the trial court.

Can a Delayed Blood Test Be Admitted Without Retrograde Extrapolation?

Tennessee appellate decisions state that a properly administered alcohol test obtained within a reasonable time after driving can serve as circumstantial evidence of the person’s BAC at the driving time. The prosecution is not required to offer retrograde extrapolation in every DUI-per-se case.

In State v. Greenwood, the court held that a test taken fifty-five minutes after driving could support a DUI conviction without extrapolation testimony. The court also stated that the defense may present evidence concerning the delay and other circumstances to argue that the later result did not reflect the BAC during driving.

Tennessee courts have declined to create a fixed bright-line rule defining a reasonable testing delay. The time between driving and testing can affect the weight of the result, and the circumstances surrounding the delay remain relevant. In Whaley, the Court of Criminal Appeals upheld the trial court’s decision not to exclude the blood result solely because approximately four hours had passed.

That ruling does not make every delayed test equally persuasive. A longer delay can increase the importance of the drinking timeline, absorption status, intervening events, test result, scientific foundation, and other evidence.

How Can Retrograde-Extrapolation Evidence Be Challenged?

A review can begin by reconstructing the timeline from the last known alcohol consumption through the sample collection. The inquiry may include drinking times, food consumption, departure, driving, the stop or crash, emergency treatment, arrest, warrant preparation, transportation, blood collection, storage, delivery to the laboratory, and testing.

The scientific opinion can then be compared with the documented facts. Important questions include what evidence supports the last-drink time, how the toxicologist determined that elimination had begun, which elimination rates were used, and why those rates apply.

The analysis should also consider measurement uncertainty, the width of the proposed range, the source material supporting the formula, and any assumptions about post-driving alcohol consumption.

A broad range that crosses 0.08% may have a different evidentiary significance from a range that remains entirely above or below the threshold. A calculated range can also be challenged when its starting test result, timing, or assumptions are disputed.

These issues may be examined alongside other methods of challenging DUI evidence, including the legality of the stop, the basis for a blood-draw warrant, chain of custody, laboratory documentation, officer observations, video evidence, and field sobriety evidence.

A weakness in one assumption does not automatically require exclusion. The court may decide that the issue affects the weight of the testimony rather than its admissibility. That decision depends on the foundation presented in the specific case.

Can a Toxicologist Identify the Exact BAC at the Driving Time?

A toxicologist can offer an estimate when the factual and scientific foundation supports one. The calculation does not transform unknown information into a direct historical measurement.

Presenting one precise number may be misleading when the person’s actual elimination rate is unknown. Both Scott and Whaley demonstrate the importance of explaining assumptions, possible ranges, and limitations rather than presenting a calculated value as certain.

The wording used by the witness matters. An “estimated range” communicates uncertainty more accurately than stating that a person had one exact BAC at an earlier time when that concentration was never directly tested.

Does a BAC Below 0.08% End a Tennessee DUI Case?

No. Tenn. Code Ann. § 55-10-401 contains separate grounds for a DUI prosecution.

Subsection (1) addresses driving while an intoxicant impairs the ability to operate safely by depriving the driver of the clearness of mind and control the driver would otherwise possess. Subsection (2) addresses driving with an alcohol concentration of 0.08% or more.

A dispute about retrograde extrapolation may be important when the prosecution seeks to establish an earlier BAC of 0.08% or more. The prosecution may also rely on driving conduct, statements, physical observations, odor, video, field sobriety evidence, and other admissible proof to pursue an impairment allegation.

In Whaley, the Court of Criminal Appeals explained that the State did not need to prove a particular BAC to support the impairment-based DUI and vehicular-homicide allegations at issue. The relevant question under the impairment provision was whether alcohol affected the defendant’s ability to operate the vehicle safely.

A calculated BAC above 0.08% also does not establish guilt automatically. The calculation, its foundation, and the remaining elements of the charged offense remain subject to proof and challenge.

Why the Complete Timeline Matters

Retrograde extrapolation is only as dependable as the information used to perform it.

Receipts, surveillance recordings, phone data, witness accounts, body-camera footage, medical records, blood-kit documents, chain-of-custody records, laboratory data, and toxicology calculations can confirm an assumption or expose uncertainty.

The evidence may support an elimination-based estimate. It may support a rising BAC argument. It may show that neither conclusion can be stated with confidence.

Retrograde extrapolation and rising BAC should therefore not be treated as automatic prosecution tools or guaranteed defenses. Their value depends on the measured result, the timeline, the scientific method, the assumptions, and the other evidence in the case.
