Federal Court Jury finds in Favor D&H client Moses

A jury in Federal Court dismissed all four civil complaints against Chattanooga Police Officer Kevin Moses after two hours of deliberation on Tuesday.
The federal civil rights lawsuit stemmed from an incident after the Souther Brewers Festival on August 27, 2007. Mr. Keys, 27, claimed Officer Moses broke his back after an arrest during an altercation at the Hamilton County Jail.
Testimony by Mr. Keys and Officer Moses differed considerably, as the officer described Mr. Keys as drunk, abusive and angry when he encountered him at 400 Market Street.
The jury apparently accepted the Officer and county officers testimony in dismissing counts of false arrest, excessive force and assault and battery. All charges against the city were thrown out by Chief U.S. Judge Curtis Collier. The court has taken the claim against the county under advisement.
Officer Moses was represented by Lee Davis, who said, "Officer Moses is grateful for the hard work of this jury who obviously understand how Chattanooga Police officers often have to make split-second decisions under stressful circumstances.
"Officer Moses regrets that Mr. Keys was injured by conduct brought about by his own voluntary intoxication."
Mr. Keys was represented by Michael Richardson, the city by attorney Phil Noblett, and the county by attorney Dee Hobbs.
