    MISDEMEANORS

In Tennessee, there are three (3) classes of misdemeanors.  There are Class A, B and C misdemeanors.  With any misdemeanor, you have the same constitutional rights to a jury trial as if it was a felony.

Class C misdemeanors are commonly motor vehicle and regulatory offenses such as speeding, wildlife violations and other petty offenses.  Class C misdemeanors carry up to 30 days in jail.

Class B misdemeanors carry up to 6 months.  One common example is reckless driving.

Class A misdemeanors carry up to 11 months, 29 days.  Some common examples include assault, domestic assault, simple possession of marijuana, possession of drug paraphernalia, and DUI.

Misdemeanors are serious criminal charges.  A conviction for a misdemeanor is permanent on your record.  You can never get a conviction dismissed or expunged and it does not “roll off” your record after any period of time.

Davis & Hoss consults with individuals routinely who had no idea that they had a conviction of their record and always thought that they could remove it from their record later in life.  Remember, what you do in your twenties, will be on your record in your forties and so on.

Contact Davis & Hoss today if you are charged with a misdemeanor.
