The Hobbs Act makes it a federal criminal offense to commit any robbery against any business which affects interstate commerce. This is a broad power under the commerce clause to the United States Constitution.
In a recent jury trial in which a client was charged with a Hobbs Act Robbery, the Government met its burden of proving that the business affected interstate commerce by showing that the business sold certain automotive parts manufactured outside the State of Tennessee as well as had a coke machine in the corner (and cokes are manufactured outside the State of Tennessee).
Robbery is a serious violent felony that carries substantial jail time. If you need assistance and representation in defending a robbery charge in federal court, contact Davis & Hoss for a free consultation.
